Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Odometer mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Matves ("we," "our," or "us"), the developer of Odometer.

2. Description of Service

Odometer is a vehicle logbook for maintenance and work trips that allows you to:

• Track and manage one or more vehicles
• Record fuel, service, repairs, and expenses
• Record trips, with business or private type, distance and odometer readings, and create trip reports
• Set reminders for upcoming maintenance
• View statistics and cost analysis
• Export your records and trip reports as CSV and PDF, or all your data as one .zip file, for free on every plan
• Optionally back up and sync your data across devices (Premium subscription)

Odometer is offered on three plans: a Free plan, a one-time Lifetime purchase, and an auto-renewing Premium subscription. Free and Lifetime logbooks are stored on your device with no account required; analytics and diagnostics are described in our Privacy Policy. Premium adds cloud sync, AI Quick Capture, and a trip allowance set by the fair-use rule in section 5.1 rather than a monthly number.

3. User Accounts

Free and Lifetime features require no account. An account using Google Sign-In or Apple Sign-In is needed for Premium cloud sync and AI. Without a subscription, you can sign in from Settings, Danger zone, to delete an existing cloud account. Cloud sync begins when an active subscriber signs in and completes any account-data confirmation. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the App.

4. Subscriptions and Payments

4.1 Plans

Odometer offers three plans: (a) a Free plan with one vehicle, the full logbook, reminders, statistics, and up to 60 new trips per calendar month, at no cost and with no account required; (b) a one-time Lifetime purchase that unlocks multiple vehicles, on-device attachments, and up to 100 new trips per calendar month, with no recurring charge and no account required; and (c) a Premium auto-renewing subscription that adds cloud sync across your devices, AI Quick Capture, and a trip allowance set by section 5.1 (Fair Use) rather than a monthly number. Every PDF and CSV export is free on every plan. Current plan details and pricing are available in the App at the time of purchase.

4.1.1 Free Trial

Eligible customers may receive a Premium free trial. Its duration, subsequent price and renewal terms are shown before purchase. At the end of a trial, the subscription automatically converts to a paid subscription at the selected plan price unless you cancel in accordance with the renewal terms. You can manage cancellation through your device's App Store settings; see section 4.3.

4.2 Billing

The Premium subscription is available in monthly and annual plans, and the Lifetime plan is a single one-time purchase. All purchases are billed through the Apple App Store. Current pricing is displayed in the App at the time of purchase. Subscription payment is charged to your App Store account at confirmation of purchase or at the end of your free trial period; the Lifetime purchase is a single charge with no renewal.

4.2.1 Data After Downgrade

When your Premium entitlement ends, you return to Free or your purchased Lifetime plan. Cancelling automatic renewal does not itself end your current entitlement. Cloud sync and AI Quick Capture become unavailable when the entitlement ends, and new trips follow the limit of the plan you return to. Existing saved trips remain available, and every PDF and CSV export remains free. Ending a subscription does not itself delete your logbook or account. Managing or deleting your Odometer account does not manage or cancel your App Store subscription.

4.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your device's app store settings:

• iOS: Settings > [Your Name] > Subscriptions

4.5 Refunds

Refunds are handled by Apple according to its refund policy. We do not process refunds directly.

4.6 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for the next subscription period after the change is announced.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit malware or harmful code
• Violate any applicable laws or regulations
• Impersonate any person or entity

5.1 Fair Use

The App is designed for personal use: one person tracking their own vehicles, including trips driven for their own work or business.

Trips. The Free plan includes up to 60 new trips per calendar month and the Lifetime plan up to 100. The monthly and yearly Premium plans set the trip allowance by fair use rather than a monthly number: they cover normal individual use, meaning your own drives. They do not cover logging trips for other drivers or for a fleet, or adding large numbers of trips that do not reflect your own drives.

AI features and cloud storage. Reasonable usage limits apply to AI-powered features and cloud storage.

If your use goes far beyond normal individual use, we may contact you and may reduce functionality or apply a limit. Fair use does not remove trips or records you have already logged, and you can export them.

These limits exist to keep the service reliable for everyone and may be adjusted as the service evolves.

6. Notifications

The App may show notifications relevant to app functionality and your account, such as maintenance reminders or a trial ending. You can manage or disable notifications through your device settings or within the App. We don't send marketing or promotional notifications.

7. User Content

You retain ownership of all data you enter into the App, including vehicle information, maintenance records, trips, photos, and notes ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely to provide the App's services to you.

You are solely responsible for your User Content and represent that you have all necessary rights to upload and use such content.

8. Intellectual Property

The App, including its design, features, code, and content (excluding User Content), is owned by Matves and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8.1 User Suggestions

If you send us suggestions, for example through Send feedback in the App or by email, we may use them to improve the App for all users.

9. Third-Party Services

The App may integrate with third-party services including:

• Google Sign-In and Apple Sign-In for authentication
• Cloud storage services for data sync
• AI services for image, PDF and text analysis and data extraction
• Analytics and crash reporting services
• Subscription management services

Your use of these third-party services is subject to their respective terms and privacy policies. When you choose AI Quick Capture, selected images or PDFs, your description, and relevant app context, including available vehicle identifiers, names and odometer readings, categories and currency, are sent through our Appwrite backend to Anthropic to extract the details and return the result. Appwrite stores extraction results or errors with your account identifier for delivery and recovery until cleanup or account deletion succeeds. Saved records and attachments follow the storage rules in our Privacy Policy. See Anthropic's privacy policy.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

The App is intended for one person tracking their own vehicles, including trips driven for their own work or business, and not for fleets or for logging other drivers' trips (see section 5.1). We do not guarantee the accuracy of any calculations, statistics, or recommendations provided by the App. Always consult with qualified professionals for vehicle maintenance decisions.

Trip reports, business-use percentages, rates and estimates are for record-keeping only and are not tax, legal or financial advice. Rules and rates change; check with a qualified adviser. You are responsible for the accuracy of what you log.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of data, loss of profits, or damages arising from your use or inability to use the App.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Matves and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

Without Premium, open Settings, then Danger zone, and use Sign in to delete cloud account in the Cloud account section, then Delete cloud account. With Premium, sign in at the top of Settings, then use Delete account in Danger zone. Deleting a cloud account also deletes the data on this device. You can contact support@odometr.app for help. If you are signed out, Delete account removes the logbook data on that device only. No subscription is required. Account deletion starts permanent removal with no 30-day cancellation period. When deletion completes successfully, we remove your Appwrite account, logbook records and associated stored attachments. The App reports a failure if its deletion request fails. Analytics and email provider deletion is handled separately and may take additional time or fail without blocking account deletion. Limited operational records and retained copies are described in our Privacy Policy. Deletion does not remove your exports or device backups, and does not cancel your App Store subscription.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying a notice within the App

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Matves only, not with Apple Inc.
• Apple has no obligation to furnish any maintenance or support services for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
