Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Odometer mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Matves ("we," "our," or "us"), the developer of Odometer.

2. Description of Service

Odometer is a vehicle maintenance tracking application that allows you to:

• Track and manage one or more vehicles
• Record fuel, service, repairs, and expenses
• Set reminders for upcoming maintenance
• View statistics and cost analysis
• Export your records (CSV on all plans; PDF on Lifetime and Premium)
• Optionally back up and sync your data across devices (Premium subscription)

Odometer is offered on three plans: a free plan, a one-time Lifetime purchase, and an auto-renewing Premium subscription. The free and Lifetime plans work entirely on your device with no account required; the Premium subscription adds cloud backup and AI receipt scanning.

3. User Accounts

To access certain features of the App, you may create an account using Google Sign-In or Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the App.

4. Subscriptions and Payments

4.1 Plans

Odometer offers three plans: (a) a Free plan with one vehicle, the full logbook, reminders, and statistics, at no cost and with no account; (b) a one-time Lifetime purchase that unlocks unlimited vehicles, on-device attachments, and PDF export, with no recurring charge and no account; and (c) a Premium auto-renewing subscription that adds cloud backup across your devices and AI receipt scanning. Current plan details and pricing are available in the App at the time of purchase.

4.1.1 Free Trial

New subscribers may be eligible for a 1-week (7-day) free trial of Premium. At the end of the trial period, your subscription will automatically convert to a paid subscription at the selected plan price unless you cancel before the trial ends. You can cancel at any time through your device's App Store settings.

4.2 Billing

The Premium subscription is available in monthly and annual plans, and the Lifetime plan is a single one-time purchase. All purchases are billed through the Apple App Store. Current pricing is displayed in the App at the time of purchase. Subscription payment is charged to your App Store account at confirmation of purchase or at the end of your free trial period; the Lifetime purchase is a single charge with no renewal.

4.2.1 Data After Downgrade

If you cancel your Premium subscription or your trial ends without subscribing, you revert to your previous plan (Free, or Lifetime if you purchased it). Subscription-only features — cloud backup and AI receipt scanning — become unavailable, but your existing data is never deleted, and any Lifetime features you purchased remain available permanently.

4.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your device's app store settings:

• iOS: Settings > [Your Name] > Subscriptions

4.5 Refunds

Refunds are handled by Apple according to its refund policy. We do not process refunds directly.

4.6 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for the next subscription period after the change is announced.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit malware or harmful code
• Violate any applicable laws or regulations
• Impersonate any person or entity

5.1 Fair Use

The App is designed for personal vehicle tracking. To ensure service quality for all users, reasonable usage limits apply to AI-powered features and cloud storage. Usage significantly exceeding normal personal use may result in reduced functionality. These limits are designed to support typical use and may be adjusted as the service evolves.

6. Notifications

The App may send you push notifications relevant to app functionality and account activity. You can manage or disable notifications through your device settings or within the App. We will not send marketing or promotional push notifications.

7. User Content

You retain ownership of all data you enter into the App, including vehicle information, maintenance records, photos, and notes ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely to provide the App's services to you.

You are solely responsible for your User Content and represent that you have all necessary rights to upload and use such content.

8. Intellectual Property

The App, including its design, features, code, and content (excluding User Content), is owned by Matves and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

9. Third-Party Services

The App may integrate with third-party services including:

• Google Sign-In and Apple Sign-In for authentication
• Cloud storage services for data sync
• AI services for image analysis and data extraction
• Analytics and crash reporting services
• Subscription management services

Your use of these third-party services is subject to their respective terms and privacy policies. When you use AI-powered features, data you provide (such as photos) may be sent to a third-party AI service for processing. The AI service does not retain your data after processing.

8.1 User Suggestions

Certain features allow you to submit suggestions to improve the App (such as custom manufacturer names). If you choose to submit a suggestion, only the suggestion content is shared with us — no personal information is included. Submitted suggestions may be used to improve the App for all users.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

The App is intended for personal vehicle tracking purposes only. We do not guarantee the accuracy of any calculations, statistics, or recommendations provided by the App. Always consult with qualified professionals for vehicle maintenance decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of data, loss of profits, or damages arising from your use or inability to use the App.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Matves and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by using the "Delete My Account" feature in the App or by contacting us at support@odometr.app. Deleting your account permanently removes all your data from our systems, including vehicle records, maintenance history, attachments, and account information. This action cannot be undone.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying a notice within the App

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Matves only, not with Apple Inc.
• Apple has no obligation to furnish any maintenance or support services for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
