Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Odometer mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Matves ("we," "our," or "us"), the developer of Odometer.

2. Description of Service

Odometer is a vehicle maintenance tracking application that allows you to:

• Track and manage multiple vehicles
• Record maintenance history, expenses, and service records
• Set reminders for upcoming maintenance
• Track equipment and accessories
• View statistics and cost analysis
• Sync data across devices (when signed in)

3. User Accounts

To access certain features of the App, you may create an account using Google Sign-In or Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the App.

4. Subscriptions and Payments

4.1 Subscription Plans

Odometer offers both free and premium subscription plans. Premium subscriptions provide access to additional features such as unlimited vehicles, advanced statistics, file attachments, and AI-powered features.

4.2 Billing

Premium subscriptions are billed through the App Store (iOS) or Google Play Store (Android). Payment will be charged to your app store account at confirmation of purchase.

4.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your device's app store settings:

• iOS: Settings > [Your Name] > Subscriptions
• Android: Google Play Store > Menu > Subscriptions

4.5 Refunds

Refunds are handled by Apple (for iOS) or Google (for Android) according to their respective refund policies. We do not process refunds directly.

4.6 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for the next subscription period after the change is announced.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit malware or harmful code
• Violate any applicable laws or regulations
• Impersonate any person or entity

6. User Content

You retain ownership of all data you enter into the App, including vehicle information, maintenance records, photos, and notes ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely to provide the App's services to you.

You are solely responsible for your User Content and represent that you have all necessary rights to upload and use such content.

7. Intellectual Property

The App, including its design, features, code, and content (excluding User Content), is owned by Matves and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Third-Party Services

The App may integrate with third-party services including:

• Google Sign-In and Apple Sign-In for authentication
• Cloud storage services for data sync
• Analytics and crash reporting services

Your use of these third-party services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

The App is intended for personal vehicle tracking purposes only. We do not guarantee the accuracy of any calculations, statistics, or recommendations provided by the App. Always consult with qualified professionals for vehicle maintenance decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of data, loss of profits, or damages arising from your use or inability to use the App.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Matves and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by using the "Delete My Account" feature in the App or by contacting us at support@odometr.app.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying a notice within the App

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Matves only, not with Apple Inc.
• Apple has no obligation to furnish any maintenance or support services for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you

Google Play Store Additional Terms

If you downloaded the App from Google Play Store, the following additional terms apply:

• These Terms are between you and Matves only, not with Google LLC
• Google has no obligation to furnish any maintenance or support services for the App
• Google is not responsible for any product warranties, whether express or implied
